Vocabulary Builder: Flashcards Terms of Service

Last updated: September 10, 2026

1. General Provisions

Please read these Terms of Service (the "Terms") carefully because they affect your legal rights and obligations. These Terms apply to your access to and use of the Vocabulary Builder: Flashcards mobile application, the webpage on which these Terms are published, and all related features, content, software, infrastructure, and support services (collectively, the "Services").

These Terms form a legally binding agreement between you and the provider of the Services (the "Developer," "we," "our," or "us"). They govern your Account, access to and use of the Services, User Content, subscriptions, and your relationship with us. They do not replace any end-user license agreement that applies to the Mobile Application through the store from which you obtain it.

Our Privacy Policy explains how we collect, use, disclose, retain, and protect information in connection with the Services. It is provided as a privacy notice and does not form part of this Agreement. You should review the Privacy Policy before creating an Account or using the Services.

By downloading or installing the Mobile Application, creating an Account, accepting these Terms in the Mobile Application, purchasing a subscription, or otherwise accessing or using any part of the Services, you confirm that you have read and understood these Terms and agree to be bound by them. You also acknowledge that you have had an opportunity to review the Privacy Policy. If you do not agree with any provision of these Terms, you must not access, install, register for, purchase, or use the Services.

You may accept these Terms only if you have the legal capacity to enter into a binding agreement and are not prohibited from using the Services under applicable law. If you use the Services on behalf of another person or organization, you represent that you are authorized to accept these Terms on their behalf, and references to "you" include that person or organization.

You are responsible for complying with all laws and regulations that apply to your use of the Services and to any User Content you submit. You are also responsible for the decisions you make based on learning materials, recommendations, recognized words, suggested translations, and other results provided through the Services.

You must obtain and maintain a compatible device, operating system, Internet connection, and any other equipment or third-party services needed to use the Services. You are responsible for charges imposed by your Internet, mobile, device, or App Store provider. Certain features require network access, system permissions, a supported application version, or an active subscription.

The Services may be unavailable or restricted in some countries, regions, languages, or platforms. You must not access or use the Services where doing so would violate applicable law. Nothing in these Terms limits any mandatory consumer right or legal protection that cannot be waived by contract.

2. Definitions

Vocabulary Builder: Flashcards or the Mobile Application means the language-learning application that allows Users to study vocabulary with flashcards, use ready-made card sets, create and manage their own cards and card sets, complete learning activities, track progress, and use optional image-based word recognition.

Website or Site means the website or webpage on which information about Vocabulary Builder: Flashcards, these Terms, the Privacy Policy, and related materials are published.

Account means the record created when a User registers with an email address or Sign in with Apple and which is used to provide and synchronize the Services.

User or you means an individual who accesses or uses any part of the Services.

User Content means card sets, words, translations, transcriptions, examples, notes, images, reports, messages, and other content that a User creates, uploads, submits, or otherwise makes available through the Services.

System Content means vocabulary cards, card sets, translations, examples, images, audio, interface elements, and other content made available by us or our licensors, excluding User Content.

3. The Services

Vocabulary Builder: Flashcards is a software tool intended to support independent foreign-language vocabulary study. It provides learning materials and training features that help Users discover, organize, practice, and review words.

Depending on your selected course, application version, device capabilities, and subscription status, the Services may allow you to:

The Services may automatically select, order, or recommend learning content based on your course settings, previous answers, card status, review dates, and study activity. These features are intended to personalize your learning experience, but you remain responsible for deciding what to study and how to use the results.

Parts of the learning experience may work with locally stored data when an Internet connection is unavailable. Authentication, synchronization, image recognition, subscription validation, and some other features require network access. We do not guarantee that offline activity will always synchronize immediately or without error.

Some content or features may require an active subscription. Features and learning materials may differ by platform, country, course, application version, or plan.

4. Accounts and Security

An Account is required to use the Mobile Application. You may register using an email address and password or Sign in with Apple. You are responsible for safeguarding your credentials, restricting access to your devices, and all activity carried out through your Account.

You must provide accurate, current, and complete Account information and keep it reasonably up to date.

You may not sell, transfer, share, or allow another person to use your Account. Notify us promptly at [email protected] if you believe that your Account or credentials have been accessed without authorization.

5. Educational Content and Automated Features

The Services are educational tools and do not guarantee a particular learning result, level of fluency, examination outcome, or amount of progress. Recommendations, review schedules, memory levels, progress calculations, and other automated learning features are estimates intended to organize your study experience.

System Content may contain errors, regional variations, alternative meanings, or material that is not appropriate for every context. A card represents a particular learning meaning, but real-world use may differ by dialect, register, or situation. You are responsible for deciding how to rely on the content and may report suspected errors through the Mobile Application where that feature is available.

Image-based word recognition uses third-party artificial-intelligence providers and may return inaccurate, incomplete, inappropriate, or unexpected results. You must review and verify recognized words and suggested translations before relying on them. The feature must not be used as the sole basis for an important decision or as professional, medical, legal, safety, or emergency advice.

6. User Content

You retain ownership of your User Content. We do not acquire ownership merely because you submit User Content to the Services.

To operate the Services, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, adapt, and process your User Content only as reasonably necessary to provide, secure, maintain, and improve the Services for you. This license includes allowing our service providers to process User Content on our behalf for those purposes. The license ends when the relevant User Content is deleted from our active systems, except to the extent that limited retention is permitted by the Privacy Policy or applicable law.

You represent that you own your User Content or have all permissions needed to submit and use it through the Services. Your User Content must not infringe intellectual-property, privacy, publicity, contractual, or other rights; violate any law; or contain malicious code or unlawful material.

You are responsible for retaining copies of User Content that is important to you. The Services are not a permanent archive or backup service, and we do not guarantee that User Content or learning progress will always be available, recoverable, or synchronized without error.

7. Intellectual Property

The Services, including the Mobile Application, Site, software, design, trademarks, and System Content, are owned by us or our licensors and are protected by intellectual-property laws. Except for rights expressly granted under these Terms or an applicable end-user license agreement, these Terms do not transfer to you any right, title, or interest in the Services or System Content.

Third-party and open-source software components included in the Mobile Application remain subject to their respective license terms. Nothing in these Terms limits any right granted to you under an applicable open-source license.

If you send us ideas, suggestions, or other feedback about the Services, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use and incorporate that feedback without restriction or compensation to you.

8. Access to and Use of the Services

Subject to these Terms, we permit you to access and use the Services for your own lawful, personal, and non-commercial purposes. Any license to install and use the Mobile Application is governed by the applicable end-user license agreement described in Section 18.

You may not copy, sell, rent, lease, sublicense, distribute, publicly display, commercially exploit, modify, or create derivative works from the Services except where applicable law expressly permits it. You may not reverse engineer, decompile, disassemble, attempt to discover source code, remove proprietary notices, or use the Services to build a competing product, except to the extent that such restrictions are prohibited by applicable law.

9. Subscriptions and Payment

Creating an Account does not require a purchase, but access to certain content or features may require a paid subscription. Available plans, prices, billing periods, included features, and any trial terms are shown in the Mobile Application before purchase.

Subscriptions are purchased and billed through the Apple App Store. Payment is charged to your Apple ID when you confirm the purchase. Unless you cancel, an auto-renewable subscription renews for the period shown at purchase, and Apple may charge your Apple ID within 24 hours before the current billing period ends. Deleting the Mobile Application or your Vocabulary Builder: Flashcards Account does not cancel an App Store subscription.

If a free trial or promotional offer is available, its duration and eligibility rules are displayed before purchase. Unless you cancel at least 24 hours before the trial ends, the subscription may automatically convert to a paid subscription. We may send you a reminder before a free trial ends, but we do not guarantee that a reminder will be sent or received. You are responsible for checking the trial expiration date displayed at the time of purchase or in your Apple ID subscription settings. An offer may be limited to eligible Users and may not be available more than once.

Apple processes all billing and payment-card information. Your purchase and use of an App Store subscription are also subject to Apple's Media Services Terms and Conditions. We do not control your Apple ID, collect your payment-card details, or have the ability to cancel an App Store subscription for you.

Subscription prices and features may change. A price change will not affect a subscription period that you have already paid for. It may apply to a later renewal only in accordance with applicable law and App Store requirements, including any advance notice or consent required by Apple.

If we offer a one-time plan described as "Lifetime," it will provide access to the features included with that plan for as long as we continue to make the Services commercially available. "Lifetime" refers to the commercial lifetime of the Services, not the lifetime of any User, and does not guarantee that the Services or any particular feature will be available permanently. Any additional terms displayed at the time of purchase and any mandatory rights under applicable law will continue to apply.

10. Cancellation and Refunds

You can manage or cancel your subscription through your Apple ID subscription settings. To avoid renewal, cancel at least 24 hours before the end of the current subscription or trial period. Instructions are available from Apple Support.

Refund requests for App Store purchases are governed and processed by Apple under its policies and applicable law. We cannot issue or approve an App Store refund. You can submit a request through Apple Support. Nothing in these Terms limits any refund or cancellation right that cannot lawfully be excluded.

11. Acceptable Use

You agree to use the Services lawfully and only for their intended purposes. You must not:

To protect the availability and quality of the Services, we may apply reasonable technical or usage limits to automated activity, image-recognition requests, and other resource-intensive operations. A subscription advertised as including unlimited words and card sets does not impose a numerical limit on the number of words or card sets you may create or store through ordinary personal use while that subscription is active. "Unlimited" does not permit automated, bulk, abusive, or commercially exploitative use. We may warn, temporarily throttle, restrict, or suspend activity that is unusually excessive, appears automated or abusive, affects other Users, or threatens the stability or security of the Services.

We may investigate suspected misuse and may remove content, restrict features, suspend access, or terminate an Account where we reasonably believe that these Terms, applicable law, or the rights or safety of another person have been violated.

12. Copyright Complaints

We respect the intellectual-property rights of others. If you believe that content available through the Services infringes your copyright or another intellectual-property right, send a notice to [email protected] identifying the protected work, the allegedly infringing material and its location, your contact details, the basis for your claim, and confirmation that the information in your notice is accurate and that you are authorized to act for the rights holder.

We may remove or restrict access to material alleged to be infringing and may suspend or terminate Accounts of repeat infringers where appropriate.

13. Privacy

Our Privacy Policy explains what information we collect, how we use and disclose it, how long it is retained, and the choices and rights available to you. It is a separate privacy notice and is not incorporated into these Terms as a contractual document.

14. Third-Party Services

The Services rely on or interact with third-party services, including Apple services for sign-in, distribution, and purchases; hosting and storage providers; analytics services; email providers; and artificial-intelligence providers used for image-based word recognition. These services may be governed by their own terms and privacy notices.

We do not control third-party services and are not responsible for their availability, security, content, or performance. A third-party interruption or change may limit a feature of the Services. More information about the providers we use and how they process information is available in the Privacy Policy.

Links to third-party websites or resources may be provided for convenience only. We do not control or endorse those websites or resources, and your use of them is subject to the third party's own terms and privacy notices.

15. Service Changes, Updates, and Availability

We may release updates, fixes, or new versions of the Mobile Application and may require installation of a minimum supported version to continue using the Services.

To the extent permitted by applicable law, we may change, replace, limit, suspend, or discontinue any feature, content, card set, language course, third-party integration, or other part of the Services, including paid features, at any time and without prior notice. We may do so for product, operational, technical, security, legal, or commercial reasons, and we do not promise that any part of the Services will remain available indefinitely. Where applicable law or App Store requirements require notice, consent, a refund, or another remedy, we will comply with those requirements.

The Services may be interrupted by maintenance, technical faults, network problems, provider failures, security incidents, emergencies, or events outside our reasonable control. We will use reasonable efforts to operate the Services but do not guarantee uninterrupted or error-free availability.

16. Eligibility, Children, and Minors

You must be at least 13 years old to create an Account or use the Services. The Services are not directed to children under 13, and children under 13 are not permitted to access or use them.

If you are at least 13 but have not reached the age of legal majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian. Your parent or legal guardian must review and agree to these Terms on your behalf and is responsible for supervising your use of the Services.

A parent or legal guardian who permits a minor to use the Services agrees to these Terms for themselves and the minor and accepts responsibility for the minor's activity, User Content, purchases, and compliance with these Terms. Subscriptions and other purchases made by or for a minor must be authorized and managed by the responsible adult through the applicable Apple ID.

Some countries or regions require a person to be older than 13 to consent to online services or to the processing of Personal Data. If the law where you live establishes a higher minimum age or requires additional parental authorization, you may use the Services only after that requirement has been satisfied.

You may not use the Services if applicable law prohibits you from doing so. You represent that the information provided when creating or maintaining an Account, including information relevant to eligibility, is accurate and complete.

If we learn that an Account belongs to a child who is not legally permitted to use the Services or whose required parental authorization has not been obtained, we may suspend the Account and delete the associated information in accordance with our Privacy Policy and applicable law. A parent or legal guardian who believes that a child has created an Account without appropriate authorization should contact us at [email protected].

17. Suspension, Termination, and Account Deletion

You may stop using the Services at any time and may request Account deletion from the Account screen in the Mobile Application. Deleting your Account is separate from cancelling an App Store subscription.

Deleting your Account may permanently remove your User Content, learning progress, study history, settings, and other Account data as described in the Privacy Policy. You should save any information you wish to retain before requesting deletion. Once deletion has been completed, the Account and data removed from our active systems may not be recoverable. If you cannot access the Account deletion feature because your Account is locked or suspended, you may contact us using the details in Section 28 to request deletion.

Deleting your Account, or the suspension or termination of your access, does not by itself entitle you to a refund or credit for any unused portion of a subscription, regardless of the reason. It also does not automatically cancel an App Store subscription, which you must manage separately through your Apple ID subscription settings. Any refund remains subject to Apple's policies, App Store requirements, and any mandatory rights under applicable law.

We may suspend or terminate your access if you materially or repeatedly violate these Terms, create risk or legal exposure for us or others, fail to pay for a paid feature, or use the Services in a way that threatens their security or operation. Where appropriate and reasonably practicable, we will provide notice or an opportunity to remedy the issue.

Upon termination, your right to access and use the Services under these Terms ends. Sections that by their nature should continue—including provisions concerning ownership, User Content permissions already required for lawful retention, disclaimers, liability, indemnification, disputes, and final provisions—survive termination.

18. App Store Terms

If you obtain the Mobile Application through the Apple App Store, your license to install and use the Mobile Application is governed by the Apple Standard End User License Agreement and applicable Apple Media Services terms. These Terms separately govern your Account, access to and use of the Services, User Content, subscriptions, and your relationship with us. If these Terms conflict with the Apple Standard End User License Agreement regarding the license to the Mobile Application, the Apple Standard End User License Agreement controls.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR EXPECTATIONS; PRODUCE A PARTICULAR EDUCATIONAL RESULT; BE ACCURATE, COMPLETE, SECURE, AVAILABLE, OR ERROR-FREE; OR THAT EVERY DEFECT WILL BE CORRECTED. YOU USE THE SERVICES, SYSTEM CONTENT, USER CONTENT, AND AI-GENERATED OR AI-ASSISTED RESULTS AT YOUR OWN DISCRETION AND RISK.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law, and any non-waivable consumer rights remain unaffected.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER AND OUR SERVICE PROVIDERS, LICENSORS, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL LOSS, OR FOR LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNT YOU PAID FOR THE SERVICES DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not exclude or limit liability that cannot be excluded or limited under applicable law, including liability for fraud, willful misconduct, death, or personal injury where such a limitation is prohibited.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless the Developer and our contractors and representatives from third-party claims, losses, liabilities, damages, and reasonable costs arising from your User Content, your unlawful or unauthorized use of the Services, your material breach of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

22. Changes to These Terms

We may update these Terms to reflect changes to the Services, law, security requirements, or our business practices. The date at the top identifies the latest version. Where required by law, we will provide additional notice or request your consent before a material change takes effect.

If you continue to use the Services after revised Terms take effect, you agree to the revised Terms. If you do not agree to a revision, you must stop using the Services and, if applicable, cancel your subscription separately through Apple.

23. Electronic Communications

You agree that we may send service-related communications electronically, including by email or in-app messages. These may include verification and security messages, password-reset information, subscription or Account notices, and legally required updates. Electronic notices satisfy any requirement that a communication be in writing to the extent permitted by law.

24. Governing Law and Disputes

These Terms are governed by the laws of Ukraine, without regard to conflict-of-laws principles.

Before filing a formal claim, the party raising the dispute must send a written notice using the contact details in Section 28. The notice should include the sender's contact details, information reasonably necessary to identify the relevant Account if applicable, a description of the nature and basis of the claim, and the requested resolution. You and the Developer agree to make a good-faith effort to resolve the dispute during the 30 days after the notice is received.

Any dispute that cannot be resolved informally will be submitted to the competent courts of Ukraine, unless mandatory consumer-protection law gives you the right to bring a claim in another jurisdiction or to rely on other non-waivable rights. Nothing in these Terms prevents either party from seeking urgent injunctive or protective relief where legally available.

25. Force Majeure

We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including natural disasters, war, civil unrest, government action, sanctions, labor disputes, widespread internet or utility failures, cyberattacks, or failure of a third-party platform or provider. We will use reasonable efforts to resume affected Services when practicable.

26. Assignment

You may not assign or transfer these Terms or your Account without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of the Services or related assets, or by operation of law, provided that the successor assumes the relevant obligations.

27. Final Provisions

These Terms constitute the entire agreement between you and the Developer concerning the subjects they govern and replace prior understandings concerning the same subjects. If a provision is held invalid or unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will continue in effect.

A failure to enforce a provision is not a waiver. Headings are for convenience only. Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and the Developer.

28. Contact

The Services are owned and operated by Bondarenko Yevhenii, an individual developer based in Ukraine.
